FIREARMS SHIPPING PROCEDURE

PLEASE READ CAREFULLY

In all instances, the Auctioneers need to be advised that shipping is required. For all licensable weapons and modern air weapons, buyers will need to nominate a Registered Firearms Dealer in their locality. The nominated RFD will send a copy of his RFD certificate to Southams by email or post, Southams will issue a copy of their own RFD certificate by return.

Where required, the purchaser must send his/her Firearm or Shotgun certificate by recorded post to: Southams, 24 Newnham Street, Bedford, MK40 3JR.

On receipt of the necessary certificate(s), the Lot(s) will be packed and the purchaser will be invoiced. Upon receipt of payment, the Lot(s) will be entered onto the purchaser’s certificate and will be shipped to the nominated RFD with the purchaser’s certificate(s).

All firearms, including modern air weapons and antique guns will be packed by Southams and shipped via Parcel Force using the standard ExpressAM or Express48 Service. Expedited Shipping & Insurance are available on request – email: shipping@southamsauction.co.uk for a quotation.

For firearms export outside the UK please contact HGSS - admin@HGSS-global.co.uk Please be aware that we are unable to ship any live ammunition.

Sundry Lots that do not require a licence (i.e. not guns or ammunition) can be collected, packed and shipped by Mailboxes Etc, who will issue their own invoice, their contact details are: Tel: 01234 305544 or info@mbebedford.co.uk

Note: Southams and Mailboxes Etc. are separate and independent businesses, therefore each must be paid individually.

FIREARMS AND AMMUNITION CERTIFICATION IS REQUIRED AS FOLLOWS:

Lots prefixed (S1): Purchasers will require the appropriate Firearms (S1) or RFD Certificate.

Lots prefixed (S2): Purchasers will require the appropriate Shotgun (S2) or RFD Certificate.

Lots prefixed (S5): Purchaserswill require Section 5 Authority or Section 1 or 2 certificate with the appropriate condition.

Lots prefixed (S58): Antique or Obsolete Calibre weapons that do not require a licence to hold provided the purchaser fully complies with the Terms of Sale (see Section 16).

Payment 

When collecting in person: 

Cash or debit card payment. Credit cards are not accepted. Maximum total cash transaction is £5000.

Remote payments:

Bank Transfer payments can be made to Acc.29033862 23-05-80 Quoting Buyer Reference Number. No remote card payments will be taken i.e. payment over the phone

Please note that for international payments you will be liable to incur all bank imposed charges.
These vary per bank so, to avoid any delay in releasing your goods, please ensure you inform your bank that you as remitter will be liable for all charges levied.

Buyers Premium:

Buyers Premium at 17.5% plus VAT will be added to the bid price of each lot.
Lots purchased via the-saleroom.com which will be charged an additional 5% plus VAT. 
Lots purchased via Southams Online will be charged an additional 2.5% plus VAT.

Commission bids: 

To avoid paying surcharges for online bidding, Purchasers may leave written instruction to bid with the Auctioneers by email directly to guns@southamsauction.co.uk 

Alternatively a Comission Bid Form can be downloaded directly from www.southamsauction.co.uk or completed in the saleroom prior to the auction. We are only able to accept commission bids until 5.00pm on the day preceeding the Sale.

Condition Reports: 

We regret that we are unable to process requests for condition reports received after 1.00pm on the day preceding the sale.

Collection of Lots Purchased - ALL COLLECTIONS AT THE DESIGNATED TIMES ONLY, AS FOLLOWS:

Thursday 10th September (12.45pm - 5.00pm) & Friday 11th September (9.00am - 3.00pm) all Lots should be collected from The Auction Centre, Eastcotts Park, Wallis Way, Bedford, MK42 0PE. 

Later collections can be made Tuesday 15th September & Wednesday 16th September (9.00am - 4.00pm) from The Stores & Administration Office, 24 Newnham Street, Bedford, MK40 3JR. 

STRICTLY NO COLLECTIONS SATURDAY 12TH, SUNDAY 13TH OR MONDAY 14TH SEPTEMBER

Any collection times other than the above by appointment only directly with the Auctioneers.

Access to the Saleroom will be subject to social distancing and maximum numbers of people at any one time. Admission is by catalogue only, priced at £10.00 (admits two). Identification may be required. The Auctioneers reserve the right to refuse access at their discretion. 

Terms & Conditions

Conditions of Sale Affecting purchasers 

1 Purchasers will be deemed a) to: have inspected their lots prior to the sale; b) to have accepted that lots are sold with all faults and imperfections specifically mentioned, or not, irrespective of whether they bid in person, by commission or through an agent.

2 All goods are second hand and sold without warranty unless otherwise stated in the sale catalogue or by the auctioneer from the rostrum. Any implied warranty, condition or other term is excluded except where to do so would be unlawful.

3 The auctioneers undertake that care has been taken to see that catalogue descriptions are accurate and reliable. However, these are matters of opinion only and shall not be taken to be statements of fact.

4 The auctioneers act as agents to the vendor and shall not incur liability to any purchaser for any statement, representation or
warranty as to title, quality or otherwise of any lot made on behalf of and with the vendor’s authority. Likewise the auctioneers shall
incur no liability to a purchaser arising from any defect in goods sold save in the event of negligence on the part of the auctioneers or their employees. Any liability therefore shall be a matter for dispute between purchaser and vendor only.

5 The auctioneers reserve on behalf of themselves and the vendors the following rights: a) To sell subject to a reserve price; b) To bid on behalf of a vendor and/or purchasers; c) To refuse any bid; d) To rearrange, consolidate, divide, add or withdraw any lots or vary the order of the sale; e) To exclude any person from the premises if there be good reason to do so.

6 The auctioneer shall regulate the bidding and shall determine from time to time the appropriate increment needed to advance the
bidding.

7 The person making the highest accepted bid shall be the purchaser as defined in these conditions.

8 If a dispute arises as to any bidding then at the discretion of the auctioneer either: a) The lot to which the disputed bid relates shall immediately be put up again; or b) The auctioneer shall determine the dispute and his decision shall be final and binding on all parties.

9 a) At the fall of the hammer the purchaser is required to give his own name (or where applicable his paddle number). If he has bid on behalf of another person, company or organisation he should make this clear to the auctioneer at the time If he fails to do so then he will be held personally liable for the purchase under the terms of these conditions b) If, and as required by the auctioneer at the fall of the hammer the purchaser shall also give his address and/or the address of his principal and/or pay to the auctioneer all or part of the purchase price plus VAT and buyers’ premium c) Any such payment made at the fall of the hammer may be treated, at the auctioneers’ discretion, as a general deposit against all purchases, made by that purchaser on the day d) All lots must be paid for in cash, or In other manner acceptable to the auctioneers. on the day of sale and before delivery is given e) Failure by the purchaser to comply with sub clause a) and b) shall entitle the auctioneer to cancel the sale and, at his discretion, to immediately re-offer the lot in question for sale by auction.

10 No transfer of lots or sub-sale by any purchaser is recognised by the auctioneers. Purchasers shall remain liable under these
conditions in respect of their own purchase under the hammer.

11 Private treaty sales shall be subject to these conditions of sale where applicable.

12 All lots will be at the purchaser’s risk from the fall of the hammer.Purchasers are therefore advised to check that they have adequate insurance cover.

13 Purchasers who pay by cheque will not normally be permitted to remove goods until their cheques have cleared through the bank. Whether removal is permitted or not, ownership of goods will not be deemed to pass to the purchaser until his cheque has cleared.

14 All lots must be cleared from the sale premises at the purchasers expense by the time stipulated or as agreed by the auctioneers.

15 a) If a purchaser fails to comply with any of the preceding conditions the auctioneers may cause the lot in respect of which the failure is made to be resold by public or private sale without warranty or reserve and without notice to the purchaser. b) If upon resale as aforesaid a lower price is obtained for any lot than was obtained on the first sale, the difference in price together with all costs and charges attending the resale shall be a debt due from the purchaser in default at the first sale. c) Alternatively the auctioneers may, at their discretion, store the lot and recover reasonable charges for so doing from the purchaser.

ADDITIONAL TERMS RELATING TO THE SALE OF FIREARMS AND AMMUNITION SOLD THROUGH SOUTHAMS FIREARMS SALES

16. Prohibited persons: The auctioneer shall consider prospective buyers or persons bidding on their behalf, to not be ‘prohibited persons’ as defined by Section 21 of the Firearms Acts 1968-97 (as amended) and prospective buyers or persons bidding on their behalf confirm that by the action of bidding, they are not ‘prohibited persons’ as defined by section 21 of the Firearms Acts 1968-97 (as amended).

17. Latent Firearm defects: If within 7 days of the sale the auctioneers receive from the buyer notice in writing stating that in his view the lot suffers from a latent defect; and further stating the grounds upon which the buyer takes that view are set out in the said notice (which shall be accompanied by any evidence upon which the buyer relies); and if within 7 days of delivery of such notice the buyer returns the lot to the auctioneer in the sale condition as it prevailed at the time of the sale; the auctioneer may rescind the sale. This is subject to the following:The auctioneer shall not rescind any sale until such time as they have certified to the vendor and the buyer that the lot is in their professional opinion suffering a latent defect. Before giving any such certificate, the auctioneers shall be entitled at their absolute discretion to seek the views of any expert or other authority. If such expert or other authority certifies that the lot is not suffering a latent defect, then the cost incurred in seeking such views shall be paid by the buyer to the vendor and shall be added to the purchase price of the lot together with VAT, where appropriate, and the sale shall proceed and be completed as required by these conditions.
