Postage:

Please check with the Auctioneers as to whether postage will be available for any lots you are bidding on.  Items will be sent by Royal Mail at the appropriate rate plus a £10 plus VAT packing charge.

Viewing:

Wednesday 10th July, Thursday 11th July and Friday 12th July 2024 10am to 4pm or otherwise by telephone appointment with Drewery & Wheeldon on 01427 616777.

Sale:

The sale opens at 9.30am on Saturday 6th July and closes from 9.30am on Monday 15th July 2024.  Please note that should any bid be received during the last 10 minutes of the sale, the chance to bid on that particular lot will be extended to 10 minutes.  Important – when bidding do not forget to refresh your screen to ensure you are aware of all current bids.

Buyers Premium & Internet Charges.

A Buyers Premium of 18% plus VAT will be charged on all lots in addition to the hammer price plus a 4.50% plus VAT internet surcharge.

VAT:

VAT at the applicable rate will be added to all purchasers invoices.

Payment:

When the sale has finished, successful buyers will be emailed a winning notification/invoice.  Payment details are at the bottom of the notification/invoice.  All lots must be paid within 7 days and before collection.

Terms & Conditions

TERMS & CONDITIONS

General:

1.            Definition

In these terms and conditions:

Drewery & Wheeldon is referred to as “D&W”.

The Drewery & Wheeldon representative conducting the auction is referred to as the “auctioneer”.

2.            Attribution and Condition of Lots

We make every effort to ensure the accuracy of any statement as to authorship, attribution, origin, date, age, provenance and condition of any lot, whether or not such statement forms part of the description of any such lot.

Any statement made orally or in the catalogue is an opinion given after careful consideration and research.

When bidding, you acknowledge that you are fully satisfied as to the attribution and condition of the lot.

3.            Third Party Liability

Every person on a D&W sale site before, during or after a sale shall be deemed to be there at their own risk and shall have no claim against D&W in respect of any injury they may sustain or any accident which may occur.

4.            Disputes

Any dispute not covered in these terms and conditions will be settled at the sole discretion of D&W.

THE BUYER:

5.            The Buyer

The highest bidder acknowledged as such by the auctioneer will be the buyer.  If any dispute arises, the auctioneers has absolute discretion to settle the matter.  The auctioneers rules the bidding and bids cannot be retracted.  The auctioneer reserves the right to refuse any bid.

The successful bidder, whether bidding for himself or for the third party, is entirely responsible for paying for the lots they have bought in accordance with D&Ws terms and conditions.

The auctioneer reserves the right to bid on behalf of the vendors for any lot and to withdraw, consolidate or divide any lot or lots.

6.            Buyers Premium

Commission Charges

Buyers premium is 18% plus VAT at current rate and a 4.50% plus VAT internet surcharge.

7.            Value Added Tax

The buyer must pay the VAT at the rates that apply on the day of the auction.

8.            Payment

Buyers must pay in full before their purchase can be released to them.

Winning notificaitons are automatically sent out at the end of the sale and buyers must pay their invoice within 7 days and let us know when they will be collecting their purchase.

Invoices which are not paid within 7 days will incur interest at 5% above the base rate, charged from the date of the sale.

If buyers are unknown to us, we cannot hand over purchases unless we have adequate references or payment is cleared.

Payment Methods

9.            Ownership of Purchases

Ownership of lots purchased will not pass to the buyer until they have paid D&W in full and the payment has cleared.

10.          Transfer of Risk

Each lot is the buyer’s sole responsibility from the fall of the hammer and is sold with all faults and imperfections.  D&W is not responsible for the correct description, genuineness or authenticity of any lot and makes no warranty whatsoever.  The buyer is deemed to have inspected each lot and satisfied himself as to its condition.

11.          Collection

Collection will be strictly by appointment  on 01427 616777 and on production of a receipted invoice. 

13.    Online Auction

The Company cannot guarantee that the internet services will operate continuously or without interruptions and this could affect the conduct of the Online Auction and the Bidders ability to Bid online.  The Company shall not be liable in any respect in the event of any dispute due to errors, omissions or disruptions or internet services or power failures or any other unforeseen circumstances which may occur during the online auction.

The Auctioneer may at any time, without notice, postpone or cancel an online auction or extend an online auction beyond the published closing time (including extension of the timed online auction in accordance with General conditions.

The timed online auction sale is auto bid extension enabled meaning that where a bid is placed within ten minutes of the original scheduled close of the timed online auction the scheduled close of the timed online auction will automatically be extended by up to ten minutes remaining.  This continues with a new scheduled close time each time a bid is placed until no-one places a bid before the last scheduled close of the timed online auction.  Every time a bid is placed within ten minutes or less left on the online auction the time will change to ten minutes bidding time until there are no more bids.  Such time shall then be deemed to be the close of the timed online auction.
