SHIPPING AND PACKAGING

Colasanti Casa d’Aste will ship the lot/s purchased only upon written request by the buyer, relasing
Colasanti Casa d’Aste from any liability; for which the buyer must apply directly the carrier.
If the buyer intends to use his/her own carrier, he/she must still pay Colasanti Casa d’Aste the packaging costs.
Colasanti Casa d’Aste will deliver the package to the shipper/carrier after being paid buy the buyer. In no case Colasanti Casa d’Aste is liable for damages relating to the transport, against which the buyer may, hower stipulate with the carrier, an insurance guarantee against all risks of transport.
If the Purchaser should not collect the lot/s within fifteen working days after the sale, the Auction house will keep them at the risk and expense of the Purchaser in the Auction house and will charge storage costs which are 25€ for each lot per month

The descriptions made in the auction catalogue indicate the period and the place of origin for each single item and their conservation state according to the opinion of our experts.

The estimates quoted with the description of every item represent the appraisal that our experts assigned to each lot.

Bidding steps in the auction room are raised in the vicinity of 10%, varying however at the discretion of the auctioneer.

Anyone unable to participate directly in the auction can avail themselves of our service of written offers by filling in the offer form, included in the catalogue or available at our offices. It is also possible to participate in the auction by telephone, where Colasanti Casa D'Aste will make the contact that will allow you to directly participate by telephone in the auction for the lots that you are interested in. Telephone calls may be recorded.
Written and telephone services offered gratuitously by Colasanti Casa D'Aste for their clients does not imply any responsibility for offers inadvertently not followed or for possible errors relative to the execution of the same. The bids will be considered valid only if received at least thirty minutes before the start of the auction.

Shipping

Colasanti Casa D'Aste will ship the lots purchased only upon written request by the buyer, releasing Colasanti Casa D'Aste from any liability, for which the buyer must apply directly to the carrier.
If the buyer intends to use their own carrier, they must still pay Colasanti Casa D'Aste the packaging costs involved. Colasanti Casa D’Aste will deliver the package to the carrier sent by the buyer only after having received from the buyer, the coupon relative to the shipping.
If the buyer intends to avail himself of Colasanti Casa d'Aste transport (DHL/BRT), they will be required to pay the shipping, which will be calculated according to the weight and dimensions of the object to be shipped, and packaging costs.
In no event will Colasanti Casa D'Aste be liable for damages relating to transport, against which the buyer may, however, stipulate with the carrier, an insurance guarantee against all risks of transport, the cost of which will be determined by the amount of the invoice.
In the case of very large or particularly fragile lots, Colasanti Casa d'Aste will provide the name of a specialized carrier in the case where the buyer is not able to personally provide pick-up.

Packaging

The packaging cost only refers to the materials used in shipping.

Terms & Conditions

Art. 1 - The lots are posted for sale by Colasanti Casa D'Aste, that act as exclusive agent in their own name and for each Seller as relates to art. 1704 cod. civ., in places open to the public. The outcome of the sale affects the Seller, and the Auction House does not assume other responsibility towards the purchaser or third-parties in general, beyond that one deriving from its own quality as agent.
Art. 2 - The objects will go to the highest bidder and payment must be settled immediately; the Auctioneer conducts the auction starting with an offer considered adequate, in relation to the value of the lot and of the competitors offers. The Auctioneer can make offers in the interest of the Seller subject to the reserve price.
Art. 3 - In case of a dispute between more than one purchaser, the disputed object will be, by the unchallengeable decision of the Auctioneer, put back for sale during the course of the same auction and newly put up for bid. The auction house will not accept transfers to third-parties of lots already auctioned and the Buyer will be held solely responsible for payment; participation in the Auction in the name and on behalf of a third-party will be accepted if a certified proxy and adequate bank references are deposited prior to auction.
Art. 4 - During the auction, the Auctioneer has the right to pair and separate lots and possibly vary the sale order. He can, at his indisputable judgement, withdraw lots in case the auction bids do not reach the reserve price agreed upon between the Auction House and the Seller.
Art. 5 - In order to improve Auction procedures, all potential bidders are required to register before the start of the Auction by presenting a valid identification. Written offers are valid if received by the Auction House at least one hour prior to the start of the Auction. In the case that the Auction House receives more than one written offer of the same value for the same lot and they are the highest bids from the Auction for that lot, the lot will be awarded subject to the offer received first by the Auction House. Telephonic participation requests will be held valid provided that they are confirmed in writing by fax; the Auction House does not assume, by any means, any responsibility towards the claimant for a failed telephonic connection.
Art. 6 - The Buyer is responsible to pay in every case, in addition to the hammer price, a commission fee for the purchase, equal to 20%, IVA included, for each lot. The additional 3% charge for purchases made over internet.
Art. 7 - Transportation of the purchased lots is at the care and expense of the buyer. If the buyer does not pick up the acquired and completely paid purchases (per art.6), he must pay to the auction house a fixed entitlement for storage, beginning on the 15th day from the sale, set at 20 Euros per week for each piece of furniture, object or painting of large dimension and 10 Euros, also per week, for every object, painting or similar item of small dimension.
Art. 8 - All Auctions are preceded by an exposition for the purpose of allowing a thorough examination of the authenticity, conservation state, place of origin, type and quality of the objects. After the award, neither the Auction House nor the Seller will be held responsible for the relative defects in the conservation state, wrong attribution, authenticity and place of origin of the objects.
Art. 9 - If after the Auction sale the lot turns out to be a forgery, that is, an intentional imitation created after 1870 with the purpose of deceiving the period, authorship and origin of the lot, the Auction House, after restitution of the lot, will reimburse the Buyer the total amount due, in the value in which it was paid by the buyer.
The obligation of the Auction House is subject to conditions that, not later than five years after the date of sale, the Buyer communicates to the Auction House in writing the reasons for which they claim the lot is a forgery and the Buyer is able to return to the Auction House the lot, free of any claims and demands by third-parties, in the same condition in which it was found on the date of sale and accompanied by a report, from at least one independent expert of known competence, in which is explained the reasons for which cause them to believe the lot is a forgery.
Art. 10 - The sale of works from the XX and XXI century is based on documentation and certification expressly cited in the catalogue under their respective description sheets. No other certificate, survey or opinion, presented at the completed sale will be valid as a protest to the Auction House for the authenticity of such work.
Art. 11 - The works already declared of great importance according to art. 6 D.L. 29/10/99 n. 490 are indicated as such in the catalogue or signalled during the sale. On such works the Italian State can exercise its right of pre-emption within a period of 60 days from the communication of the completed sale; the sale, therefore will be effective only after the end of this period. In the case in which the right of preemption is effectively exercised, the buyer will have the right of reimbursement of the sum already paid.
Art. 12 - The exportation of a lot from the territory of the Republic of Italy, especially a work more than 50 years old, is subject to the regulations contained in D.L. 29/10/99 n. 490 (art. 65-72). The release of the relative certifications of free circulation is the burden of the buyer. The missing or late release of one or any license does not constitute a cause for cancellation or annulment of the sale, nor does it justify late payment on the part of the Buyer for the total amount due.
Art. 13 - These rules come by tacit agreement by those competing in the present auction sale.
Art. 14 - The said Conditions of Sale are regulated by Italian law. Every dispute that may arise in relation to the application, interpretation and execution of the present conditions is exclusively assigned to the Court of Rome.
Art. 15 - For who sells at auction, in compliance with Legislative Decree 13 February 2006, n 118 "Fulfilment of directive 2001/84/CE, relative to the rights due to an author (living, or for 70 years after his death), during the successive sales to the first of a work of art", published in the Gazzetta Ufficiale n. 71 in 25 March 2006, or rather the rights of the author, Colasanti Casa D'Aste di Luigi Colasanti, in case of the sale of a work of art, will retain from the seller the amount that must be paid to S.I.A.E. according to the table in article 8 of the same Legislative Decree, hereby determined as:
• 4% of the hammer price between 3.000,00 euros and 50.000,00 euros;
• 3% of the hammer price between 50.000,01 euros and 200.000,00 euros;
• 1% of the hammer price between 200.000,01 euros and 350.000,00 euros;
• 0,50% of the hammer price between 350.000,01 euros and 500.000,00 euros;
• 0,25% of the hammer price greater than 500.000,00 euros.
The total amount of the fee cannot be more than 12.500,00 euros.
