The company SAS Auctie's SVV (hereinafter referred to as "Auctie's" or "We") is an operator of voluntary public auctions of furniture governed by Articles L.321-4 and following of the French Commercial Code. In this capacity, Auctie's acts as an agent for the seller.
The relationship between Auctie's and the buyer (hereinafter referred to as the "Buyer" or "You") is subject to these general terms and conditions of sale.
The voluntary sale is subject to French legislation and will be expressly conducted for immediate payment.
BEFORE THE SALE
1.1 Indicative nature of estimates
The estimates are provided for information purposes only and should not be interpreted as a certainty that the item will be sold at the estimated price or within the estimated range.
The estimates provided by Auctie's do not constitute a guarantee and may vary prior to the sale.
Any bid made within the estimated range has reasonable chances of success.
1.2 Condition of the lots
We are available to provide you with a detailed report on the condition of the lots.
All goods are sold in the condition in which they are at the time of the sale, regardless of any imperfections or defects. No claims will be accepted once the auction is concluded, as the successive viewings and the possibility of requesting a detailed report have allowed Buyers to examine the condition of the objects offered for sale.
It is specified that visitors and potential Buyers have the possibility, upon request, to access a more comprehensive examination of the objects presented.
1.3 Exhibition before the sale
The pre-sale exhibition is open to everyone.
Auctie's endeavors to display the objects in the safest manner possible for security reasons. You are prohibited from handling the objects without the authorization of Auctie's.
Any unsupervised handling of objects is done at your own risk.
THE AUCTION
Bids can be made in person, by telephone, or through a third party. The bids will be conducted in euros.
2.1 Bidding in person
In order to participate in the auction in person, a means of payment (cheque or credit card details) and the buyer's personal information (name and address) must be provided to the auction house before the sale. A bidder number will be provided in return. This number will identify the Buyer in case of lot acquisition.
Access to the auction room is free, and no pre-registration is required.
When making a bid, the potential Buyer present in the auction room signals their intention to bid by a gesture towards the auctioneer.
If there is any doubt regarding the price or the Buyer of an item during the auction, You can immediately draw the attention of the person authorized to conduct the sale.
Auctie's conducts the auction while ensuring the freedom of bidding.
2.2 Bidding by telephone
If You are unable to attend the auction in person, You have the option to bid directly by telephone, provided that You have notified us 24 hours prior to the sale.
We also recommend indicating a cover bid that we can execute on your behalf in case we are unable to reach you.
Auctie's cannot be held responsible for technical difficulties related to poor telephone connections.
2.3 Proxy bidding
When You bid during the auction, You do so on a personal basis, and we may hold You solely responsible for the payment of the auction price, as well as any applicable taxes or fees, unless You have previously notified us that You are bidding on behalf of a third party by providing us with a duly registered proxy.
2.4 Written bids
In the event that You are unable to attend the auction, Auctie's offers to execute the written bids that You have previously trasnmited.
2.5 Conclusion of the purchase agreement
The purchase agreement is concluded when the highest bidder at the auction is declared the winner. Auctie will notify the winning bidder via email within a reasonable period of time after the auction ends. The winning bidder is required to complete the payment within the specified timeframe and in accordance with the payment instructions provided by Auctie.
2.6 Payment
The winning bidder is responsible for making the payment for the purchased item. The payment must be made in the currency specified in the auction listing and using one of the accepted payment methods. Auctie may require the winning bidder to provide additional information or documentation for verification purposes.
2.7 Delivery
Upon successful completion of the payment, Auctie will arrange for the delivery of the purchased item to the winning bidder. The delivery will be made to the address provided by the winning bidder, unless otherwise agreed upon. Cancellation and returns
